OpenScope Health, Inc. — Terms of Service
Effective Date: September 11, 2025
These Terms of Service ("Terms") govern your access to and use of the OpenScope Health, Inc. web-based and mobile educational platform (the "Product"). By accessing or using the Product, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Product.
1. Educational Use Only — No Medical Services
The Product is strictly an educational health information platform designed to help users learn about general health concepts by algorithmically organizing publicly available medical literature.
The Product does NOT:
- Provide medical advice, professional diagnosis, or treatment recommendations
- Create a doctor–patient relationship
- Replace consultation with a qualified healthcare provider
By using the Product, you expressly acknowledge and agree that:
- All content is for educational purposes only
- You are solely responsible for all healthcare decisions
- You must not rely on this Product to diagnose or treat any medical condition
- You will always seek professional guidance from a licensed clinician for any medical concerns
2. Not for Emergencies
The Product is not designed for medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.
3. Regulatory Status
OpenScope Health, Inc. is not a covered entity or business associate under HIPAA. While we use strong data protection practices similar to HIPAA standards, HIPAA does not govern this Product.
We comply with applicable privacy laws, including the California Consumer Privacy Act (CCPA) and General Data Protection Regulation (GDPR), to the extent they apply.
4. User Responsibility and Prohibited Conduct
You agree not to:
- Input any personally identifiable information ("PII") or protected health information ("PHI")
- Attempt to use the Product to provide or receive medical diagnosis, treatment, or prescriptions
- Misuse the Product for unlawful or fraudulent purposes
- Interfere with the operation of the Product or its infrastructure
If you submit PII or PHI in violation of these Terms, you do so at your own risk, and OpenScope disclaims all liability.
5. Accounts and Authentication
Currently, no user accounts or authentication are required to access the Product. This decision was made to reduce regulatory complexity and protect user privacy.
Future features may require account creation, at which point you will be provided with updated Terms and must opt in.
6. Data Collection and Use
We collect only anonymized, non‑identifying session data to improve the Product and train our models.
Types of Data Collected
- Session Data: Anonymous symptom queries and usage patterns
- Technical Information: IP address (for regional compliance only), browser type, device information
- Affiliate Tracking: Click data for referral tracking (Amazon, Impact, CJ, Go2Cloud, Katalys)
Retention
Anonymized session data is retained only as long as necessary to:
- Improve our algorithms and educational features
- Support aggregate analytics
- Enhance future services
Once data is no longer needed, it is securely deleted or aggregated for statistical analysis.
Research and Partnerships
We may also use anonymized and aggregated data — which cannot be used to identify you — for research, analytics, and collaboration with trusted partners.
Opt‑Out
Users may request that their anonymized session data not be used for model training or research by emailing legal@openscopehealth.com
. This opt‑out applies only to future data collection and does not affect data already anonymized and aggregated.
7. Accuracy Disclaimer
The Product may display information that is outdated, incomplete, or inaccurate. OpenScope does not guarantee the accuracy, reliability, or completeness of any health information provided. You agree to independently verify any information before making healthcare decisions.
8. Third‑Party Services
The Product relies on the following third‑party providers:
- Hosting & Infrastructure: Vercel (frontend), Neon Postgres (database)
- Analytics: PostHog, for aggregate and anonymized behavior tracking
- Affiliate Tracking: Amazon Associates, Impact, CJ, Go2Cloud, Katalys
While we carefully select our service providers, we are not responsible for the privacy, security, or practices of these third‑party providers, and their handling of data is governed by their own privacy policies.
9. Limitation of Liability
To the fullest extent permitted by law:
- OpenScope Health, Inc. shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Product; and
- In no event shall our total liability exceed one dollar ($1.00).
10. Dispute Resolution
Any dispute shall be resolved exclusively through binding arbitration under the rules of the American Arbitration Association (AAA). These Terms shall be governed by and construed under the laws of the State of Delaware, without regard to conflict‑of‑law principles.
11. Modifications
We may update these Terms at any time. Changes will be posted here with an updated Effective Date. Continued use of the Product after changes constitutes acceptance of the revised Terms.
